The plaintiff, A. N. Besnah, owned a parcel of downtown real estate in the city of Fond du Lac totaling about 45,000 square feet, a little over one acre. On November 17, 1965, the defendant city initiated condemnation proceedings under sec. 32.06, Stats., to acquire a piece, about 4,500 square feet in the area, of the plaintiffs parcel for parking-lot purposes. On February 3, 1966, the condemnation commissioners viewed the parcel and held a hearing on the proposed condemnation. The plaintiff appealed the commissions award of $4,000 to the circuit court. The matter was tried to a jury. The jury verdict found the fair market value of the whole Besnah property immediately before taking to be $67,500 and the fair market value of the remainder after taking to be $52,500. These jury findings resulted in damages in the amount of $15,000. Motions after verdict by the city were denied and judgment was entered on the jury findings. The city has appealed.
